Photo Release

1. I hereby grant Voya Services Company, its parent, subsidiaries, affiliates, employees, agents, and assigns (collectively referred to as “Voya”) for any and all purposes including, but not limited to, advertising, promoting and publicizing Voya and its businesses, products, services or any promotion or offer presented by Voya in any and all media, including but not limited to social media, the Internet, print, and at future Voya events, the absolute right and permission without any additional consideration: (a) to use my name, city and state of residence, employer, and any other information or statement I may provide to Voya (collectively, “Personal Information”); and (b) subject to Paragraph 2 below, to use, adapt, reproduce, disseminate, publicly display, incorporate into another work or otherwise exploit any video, image, likeness, drawing, and photograph of me (“Likeness”).
2. I understand that I shall have no right of review, approval, or compensation and no claim (including, without limitation, claims based upon invasion of privacy, defamation, right of publicity and/or infringement of an intellectual property right) arising out of any use of the Personal Information or Likeness.
3. I release, discharge, exempt, and agree to hold harmless Voya and anyone working on its/their behalf, and each of their respective affiliates, parent companies, subsidiaries, representatives, distributors and advertising/promotion agencies, and each of their respective directors, employees, officers, shareholders and agents from any and all actions, claims, demands, costs, liabilities, losses, damages and expenses (including, without limitation, attorneys’ fees, costs and disbursements) of any nature including, but not limited to, any negligence or derivative claim that I (or my heirs, executors, administrators, successors, assigns or third parties) may have whether now known or unknown, that are based on, arise out of, relate to, concern or involve Personal Information, Likeness, or any activity or promotional effort related to any of the foregoing, or related to and/or covered by Paragraph 1 of this Release.
4. I waive any right I may have to dispute the scope of this general release on the grounds that it is a general release and a release of unknown claims. I understand that I have the opportunity to seek independent legal counsel prior to signing this Release.
5. I agree that this Release shall be construed in accordance with and governed by the internal law of the State of New York (without reference to its rules as to conflicts of law) and venue for resolution of any dispute shall be federal, state and local courts located in New York, New York.
6. I declare that all information I submit in this Release is true and correct. I attest that I have read, or have had read to me, and understand all the foregoing provisions of this Release, prior to its execution, and agree this release shall be binding upon me and my heirs, legal representatives and assigns.
